Clyde Carrière of Embrun was vacationing in Cuba with his family when police seized his passport last Friday. He has been detained in his room at Sol Cayo Coco hotel ever since.
His wife, Lynne, walked out of a massage without paying after the masseur allegedly began touching her breast, kissing her and telling her she was beautiful.
Carrière says he broke the man's ankle during a scuffle with the masseur later that day.
Carrière says a Cuban lawyer told him he might face a fine and have to pay damages, but would probably not end up in jail.
Lynne and their two children returned home on Friday.
